20/25-LIMITED WARRANTY

PRODUCTS AND PERSONS COVERED

This limited warranty (the “warranty”) covers number one grade Certi-Split cedar shakes, number one grade Certi-Sawn cedar shakes, number one grade Certigrade cedar shingles, and number one grade Certi-Ridge cedar shake or shingle ridges (collectively the “warranted products”) produced by members in good standing of the Cedar Shake & Shingle Bureau. The warranty is extended to the original home/building owner (the “original owner”). The warranty may be transferred by the original owner to any other person or entity (the “transferee”) a total of (1) time, provided that the transfer is made within seven (7) years after the original installation date of the warranted products. In the event of such a warranty transfer, any provision or requirement of this warranty that applies or refers to the original owner shall become applicable to the transferee. Written notice and payment of a warranty transfer fee of $25 (U.S.) to the Cedar Shake & Shingle Bureau is required before any warranty transfer shall become effective. The Cedar Shake & Shingle Bureau reserves the right to modify or rescind this warranty transferability rovision (including the amount of any warranty transfer fee) at any time.

TERMS OF LIMITED WARRANTY

Subject to the limitations and exclusions set forth below, the Cedar Shake & Shingle Bureau warrants to the original owner that (1) the warranted products have been inspected, graded and labeled under the Cedar Shake & Shingle Bureau’s inspection and certification program in accordance with the applicable Cedar Shake & Shingle Burequ standards, and (2) for the period (the “warranty period”) specified below, which is measured from the date of installation, the warranted products will remain free from leaks caused by original product defects proscribed under the official grading standards used in the Cedar Shake & Shingle Bureau’s inspection and certification program.

REMEDIES

If a warranted product leaks within the applicable warranty period due to an original product defect proscribed under the official grading standards used in the Cedar Shake & Shingle Bureau’s inspection and certification program, upon receiving a bona fide warranty claim the Cedar Shake & Shingle Bureau will, at its sole election and subject to the limitations and exclusions set foreth below, either (1) furnish and install replacement shakes or shingles, or (2) refund a pro rata portion (the “pro rata refund”) of the amound the original owner paid for the purchase and installation of the defective shakes or shingles (the “purchase/installation price”). These remedies are the eclusive remedies available under this warranty.

In the case of replacement, the Cedar Shake & Shingle Bureau shall be responsible only for the cost of purchasing and installing replacement shakes or shingles (the “replacement costs”) up to a maximum amound equivalent to the amound of any pro rata refund that would be paid for the same warranty claim. The original owner shall be responsible for any replacement costs above this maximum amound, as well as any additional expenditures for labor or materials such as tear-off (product removal) costs, or the cost of installing, repairing or replacing venting, metal work, flashings, underlayments, fasteners or other related materials.

In the case of a pro rata refund, the amount of the refund shall be determined by multiplying the purchase/installation price by the percentage of the warranty period remaining (determined by dividing the number of months remaining in the applicable warranty period by the total number of months in the warranty period) as of the date the original owner submits the warranty claim.

LIMITATIONS AND EXCLUSIONS

This warranty shall not be effective unless each and every bundle of shakes or shingles applied to the roof or exterior wall carries a Cedar shake & Shingle Bureau number one grade Certi-Split, Certi-Sawn, Certigrade or Certi-Ridge label.

This warranty shall not apply to cedar shakes or shingles installed in Alabama, Delaware, Florida, Georgia, Hawaii, Kentucky, Louisiana, Maryland, Mississippi, North Carolina, South Carolina, Texas (in the counties of :Angelina, Austin, Brazos, Chambers, Fort Bend, Galveston, Grimes, Hardin, Harris, Jasper, Jefferson, Orange, Liberty, Montgomery, Newton, Polk, Sabaine, San Augustine, San Jacinto, Trinity, Tyler, Walker, Waller, and Washington), Virginia and West Virginia, unless they are Certi-Last preservative treated cedar shakes and shingles warranted under the Certi-Last 30-year warrranty program, which is seperate from this warranty.

This warranty does not cover:

1. Improper Installation. Product failure due to improper installation, or application not in accordance with the specifications of the Cedar Shake & Shingle Bureau’s New Roof Construction Manual or Exterior & Interior Wall Manual.

2. Tear-Off and Other Costs. Tear-off (product removal) costs, or the cost of installing, repairing or replacing venting, metal work, flashings, underlayments, fasteners or other related materials:

3. Unapproved Installation. Products that are not installed by an approved Affliate Member roofer or contractor of the Cedar Shake & Shingle Bureau on walls or roofs of 4/12 pitch or steeper according to the specifications of the Cedar Shake & Shingle Bureau;

4. Unapproved Use. Cedar shakes or shingles that are used for any purpose other than roofing or exterior wall siding;

5. Extended Risks. Product failure due to hurricane, tornado, hail, lightning, flood, fire explosion, mudslide, earthquake, volcanic eruption, falling objects, aircraft, vehicles, accidents, riot, civil commotion, war, or acts of God;

6. Failure Caused By Other Circumstances. Product failure caused by settling of the building foundation, warping, distortion, failure of the roof dect or walls, or damages caused by ventings, metal work, flashings, underlayments, fasteners, or other materials used in the application of the roof or exterior wall;

7. Neglect. Product failure caused by neglect, misuse, or imporper upkeep and maintenance.

8. Improper Handling. Product failure caused by improper handling, shipment or storage;

9. Improper Maintenance. product failure due to buildup of moss, leaves, needles, branches or other debirs;

10. Insects or Animals. product faiulre caused by insects or animals.

11. Improper Ventilation or Drainage. Product failure caused by improper ventilation or roof drainage that is not in accordance with FHA or Cedar Shake & Shingle Bureau standards.

12. Modifications. Product failure due to repairs or alterations made to the roof or walls after their original installation.

13. Paints or Coatings. Product failure or damage caused by paints, coatings or other solutions; or

14. Factors Beyond the Bureau’s Control. Product failure caused by factors that are beyond the control of the Cedar Shake & Shingle Bureau. The serviceable life of a cedar shake or shingle is affected by several factors such as climate index, quality of installation, maintenance, normal wear and tear, ventilation, and the type and quality of underlayments. The Cedar Shake & Shingle Bureau assumes no responsibility for product failure or damage caused by these factors.

DISCLAIMER AND LIMITATION OF LIABILITY

THIS WARRNATY IS IN LIEU OF ANY OTHER WARRANTY OFFERED BY THE CEDAR SHAKE & SHINGLE BUREAU, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED, AND, EXCEPT AS EXPRESSLY PROVIDED HEREIN, THE CEDAR SHAKE & SHINGLE BUREAU DISCLAIMS ALL WARRANTIES OR REPRESENTATIONS REGARDING ANY SPECIFIC QUALITIES OR CHARACTERISTICS FOT EH WARRANTED PRODUCTS, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE CEDAR SHAKE & SHINGLE BUREAU SHALL NOT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, PERSONAL OR PROPERTY DAMAGES (INCLUDING DAMAGES TO THE BUILDING OR ITS CONTENTS, OCCUPANTS OR INSTALLERS) RESULTING FROM PRODUCTS COVERED BY THIS WARRANTY OR THEIR INSTALLATION, SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OF INCEDENTAL OF CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU, THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

WARRYANTY REGISTRATION

This warranty is effective upon proper registration with the Cedar Shake & Shingle Bureau and the issuance of a Warranty Acknowledgment by the Cedar Shake & Shingle Bureau to the original owner. To register a warranty, the original owner must submit a completed Warranty Registration form, to the Cedar Shake & Shingle Bureau within thirty (30) days after installation of the warranted product. Upon receipt of the completed Warranty Registration form, together wih all materials required from the installer, the Cedar Shake & Shingle Bureau will issue a Warranty Acknowledgment card to the original owner.

CLAIM PROCEDURE

To make a claim under this warranty the original owner must, within thirty (30) days after discovery of the alledged defect to which the claim relates, send a written description of the claim along with copies of the Warranty Registration form and Warranty Achnowledgment card to: CEDAR SHAKE & SHINGLE BUREAU*515-116TH AVE. The Cedar Shake & Shingle Bureau and/or product manufacturer reserve the right to have a representative inspect all warranted products that are claimed to be defective under the terms of this warranty. Any alteration, removal, or repair of material claimed to be defective prior to settlement of the claim shall bar any right to seek relief under this warranty.

ENTIRE WARRANTY

This document contains the entire warranty and may not be altered by any wholesaler, dealer, roofer, contractor, representavie, or manufacturer. Of course, any manufacturer or other person is free to offer its own independent warranty covering the same products warranted here.

As an afflitated member of the Cedar Shake and Shingle Bureau, Cedar Roof Design is one of the few companies in Michigan authorized to offer the Bureau backed warranty on our roof installations.
